At what point is the upset no longer an upset?

Unless there's a tie for third.

After the 1st place ties in 1996, 1999, and early 2000's, didn't DCI put a tie-breaker in place to prevent that, or is that "creative memory"?

I thought DCI set up a tie-breaker after we had 4 chaps in in only 2 seasons (BD/SCV tie in 99; Cadets/Cavies in 2000).  Personally, I like the way DCM handled it in 1982 with a march-off.

Anyway, is there a tie breaking mechanism in place?

Well, now that a judge can score out to 0.05 in any caption it's highly unlikely there would ever be a tie. But my understanding is if there were it is whomever wins the most sub captions wins.

There was! But it got eliminated in the 2008/2009 offseason. Reference here.

OK, thanks! Not sure how I missed that one.  As much as I don't like ties (except for maybe 12th place at semi-finals), I think a tie is better than what amounts to almost a "flip of the coin" in deciding the winner.
