  1. I wish that instead of softball Dan Potter questions some real journalist could ask some real hard questions & get real answers from Nate B. I also that until all the legal process is complete (Inc SoA & anything else that might pop up between now & then) that DCI’s lawyers will strongly advise that no public comments should happen. Again- sound legal strategy & optics/doing the right thing are at odds with one another.

  3. Thanks. This is the legalese of DCI claiming ‘this wasn’t our job back then’. We’ll see whether it works or not. The retroactive extension of the SoL was in response to Me Too & is a lot bigger than this lawsuit. If DCI prevails here, there will be a big fight in Appellate Court. It will be interesting to see if the counter claim for DCI’s legal fees succeeds. And if I read this correctly, if Cadets settle, DCI is going after part of the settlement to cover their expenses. From an optics standpoint, still not the best look as the face of the activity for DCI to claim that SA within the activity isn’t our problem.

  5. I remember shows from that era w/ partial judging panels. In DCM they would sometimes give zero in caption not scored so max score would be in mid 80s
  6. 2022 SoA & the DCI post hopacalyptic situation may well be different. ETA - And regarding Cadets lawsuit- even if plaintiff doesn’t prevail it is still costing DCI $ for legal fees, which during discovery (which has likely already happened) & trial go up quickly. So, in a sense, DCI has already been dinged.
  7. Also keep in mind that DCI is now a defendant. I wonder if plaintiffs lawyers have realized that even if they prevail, CAE has nothing that can be used to pay damages. DCI however, has some cash in the bank. I suspect much of that cash is already committed to 2024 season operations.

  9. If it does go to trial, I hope someone with a Drum Corps background attends & reports what happened. I wonder if Tricia Nadolny plans to attend ? This is within the sphere she covers & she was at the GH plea & sentencing.
  10. Makes me wonder if plaintiff’s lawyer realized that even if they win, there won’t be $ for him to collect his fee from. Or maybe it is just a housekeeping move by the Court & we see a trial in June.
  11. If that is case w/ Cadets, it seems rather late in the process as this is several years in, with a court date set. I wonder if it is dismissed w/r/t Garfield Cadets as defendant, but ongoing for The Cadets and/or DCI? Or once it is dismissed against one defendant, does it automatically apply to all defendants? I suspect that we’ll find out in the next few days.

  17. And it doesn’t help that there aren’t parents available to sign up for this, even if they wanted to, because the membership is national. I wonder how many WC members in 2023 lived within a 100-mile radius of where their Corps is based?

I marched at the tail end of that era; from our 50-member Corps we had/have 2 college professors, several military officers, an Alaska crab fisherman, several government employees, engineers, a spy, a Catholic priest (no one saw that coming), multiple financial and tech industry professionals, several business owners, 2 band directors and probably more that I don’t know of. And we can trace it to the ethos taught in Drum Corps. All from one little Corps.

  20. As you know, these shows can be very creative & entertaining. It takes a special kind of talent & attitude to throw it down when you don’t have 110 more members backing you up. I just wish they had packed stands for Open Class finals.
