    The bankruptcy does not end the case.  Just because the judge won't let them out as a Defendant doesn't mean they have been "found liable" so to speak for the past transgressions of the corps specifically as a legal standard going forward.  CAE could still technically prevail on this particular case and incident and be found not liable for it.  If the basis of that decision, as a judicial order takes it a step further specifically on the record declaring that they are not liable for the former orgs in any way, an astronomically against the odds revival has a possibility in the future.

    That said, I highly doubt that's how it would go.  Far more likely that any CAE win would just find them not liable for the incident alone (there are decent arguments to be made here outside the legacy question).  It's even less likely I think that this thing ever makes it to a trial so such a thing could even occur.

    So - it's still theoretically possible, sure.  Exceedingly slim chance IMO.

    it was said elsewhere the lawyer had others waiting in the wings.

    Didn't people say when all this started with GH that they would never come out? Parents wouldn't let kids march? who would work there? well none of that happened and had pretty competitive years as well as top 5 last year.

    at the time it first came out, YEA dragged their feet on doing anything about him, making DCI basically threatening to lower the boom. then the whole mess of old board new board, resign, quit.....i am amazed they survived 18 let alone after 18. 

     

    if there is any video of the corps performance in Allentown from 18...not the backside video at the zpull, but the actual Flo feed, i'd love to see it. it was magic.

Yes, this is a big one hard to bounce back from and YES there are circumstances that could make it nearly impossible ( unfortunately ) but this corps on a shoe string survived the upheaval from Holy Name to Garfield Cadets and  many other times in their history. Of course this is different but this corps also survived when the murder of a drum major happened BITD. Many said they were done then . Should they survive, can they survive, deserve to survive? Others can debate that. Count them out as done forever? I wouldn't be so sure of that. Not the same of course but many thought just recently that SCV wouldn't return, let alone so fast. I'm hopeful 

    literally the name has zero value because if you own it, and new claims were to come up, guess who has to deal with it?

     

    it's damaged goods. there's far more negative to trying again then to actually try again.

    Just to avoid any possible misunderstanding, when I said Blue Devils were "taking over" USBands, I understood that to be a legal, consenting arrangement that was announced publicly... not a hostile takeover.

    No it was more a dumpster fire sale. And based on all I have seen and heard no one could confuse how it’s run now with under YEA.

    At this point, you probably cannot bring back Marion Cadets - they had both name and uniform similarities.  The whole Erie area is probably banned from starting anything right now, despite having had corps of their own in the past.  And forget anything tied to the Bonfiglio family.  Surprised they are not dragging Blue Devils into it just for taking over the band circuit.

    USBands was sold legally. may have been before a Bankruptcy there, i can't remember

    Terri makes common sense statements! I think every member might need to be checked. As in the past, some members have had issues with sex abuse. If you go back decades you'll find out it happened a lot in this activity. No one said things back in the 70's. By this time DCI should protect themselves and the activity from pedophiles and others. It's not the 70's, it's 2024 and we have seen the evil things that have happened in drum corps and the directors of each corps (along with their BOD) should clean up ALL of our activity. I won't recommend a student to march with any corps. 

    Today the staff's are so large, any creep could hide amongst the rest. Who watches them? Who notices a staff member getting to friendly with a corps member? No security, NO safety! If I had children old enough to march I would say NO today!

    Terri makes valid statements and probably based on knowledge as she marched in some pretty good corps!

    First of all, you haven't gotten a response and you are jumping,ping to a huge conclusion here

     Alumni groups are ALL ADULTS. Soundsport groups DO background check staff, but the participants are all KIDS. DCI doesn't;t background check the performers either because they are kids. They all complete safesport. What else do you expect DCI to do? 

    Do you have anything to do all day rather than stir up drama here? And what does any of your post have to do with the cadets bakruptcy. 

    Why do you insist on turning every thread into a "DCI isn't doing enough and doesn[t care".

     

    incorrect. not all alumni corps are all adults. outside of special project one offs, most if not all alumni corps have non alumni in the ranks.

The question for me is would it be the same or has too much water passed under the bridge?

    well, the fact it wasn't a corps sponsored function would have been an area i'd have gone after. also, if true, that the victim has a history of filing these lawsuits yet has had no victories, then there's a pattern and motive there. again, i don't condone what happened to the victim, nor do i condone the victim not being removed from staff, even in the rules or lack thereof in 1982. but with someone that specializes in this type of legal situation, i'm thinking the right lawyer makes a difference.

    Soundsport and Alumni groups don't tour, they essentially meet on a few weekends to get their act together and meet up at DCI. They have no money - and could never afford background checks the way corps that tour do. Should every adult community sports league background check the participants? Because that is the equivalent of an alumni group. Everyone is an adult. 

    if you're participating in DCI, you follow their rules. end of story
