Capturing live streams for your own use isn't illegal, and is covered under fair use law (even if the site's TOS says otherwise). It's only an issue if you redistribute it.

So, we've fixed it for you.

Fair use is much more nebulous than one might think. It is being attacked a bunch by the various media even today, because they want 100% control of who, where, and when. The various organizations want to monetize as much as they can... and it is not as cut-and-dry as some people present it. In one instance, copying 5 seconds of music could be ok, but in another instance it might not be ok. What the courts have said was "ok" in the past about using a VCR to record a show over the air is being challenged for new digital media types.

However, I would still capture a live stream for personal use and not distribute it.

I have no inside information, but I've been very curious about the rationalization used to make the FN - DCILive format. There simply must have been a reason and, of course, odds are it's financial.

So here's my take: I remember a revenue number of $700m and I recently heard that DCi expected to lose 40% of that revenue in the switch to the new platform.

So why is that acceptable (assuming that 40% is accurate)? It only makes sense when you consider the cost of the platform. Before, if they were spending $600m to get $700m in revenue, then their net is $100m. If they're now earning $420m but paying $200m for the Nuelion platform, DCI's net more than doubled and they have fulfilled their obligation to the taskmaster drum corps.

(disclaimer: I have no actual knowledge except for the $700m revenue number. But this type of end result is the only thing I can think of that would justify such a dramatic change in platform product offered by DCI to fans.)

m=thousand? :blink:

Mike

Cause if they're pulling that many millions…you'd think they could afford a better legal team to fight back on this stuff.

Hell - if they were pulling THAT much, they could afford Johnny Cochran (or his ghost).

They could just BUY the licensing company and give themselves ALL the permissions.

Thank you for clarifying the 'm'. I just about spat my gin and tonic out at the thought of DCI bringing in close to three quarters of a billion dollars from FanNetwork.

Lol

"M" in the financial markets is thousands. "K" isn't used anywhere.

I don't understand how, after decades of DCI recording and releasing these performances, that this is all the sudden now a pressing issue. Most people can barely force their friends to watch a drum corps vid. It's a niche market of people buying this stuff. Just makes me wonder how this escalated so quickly.
