Fleetwood Sounds added to Inspire Arts & Music Portfolio

Inspire Arts & Music is proud to announce that it has been selected to run Fleetwood Sounds, a leader in providing historical recordings to the drum corps

activity. We are grateful for the leadership of board member Michael J. Woodall in acquiring this precious asset.

The aquisition will allow Inspire and the Boston Crusaders to run and be the sole beneficiary from the proceeds of operating Fleetwood Sounds. The operation will be moved from Lynn to the Inspire Arts & Music headquarters in Hyde Park, MA.

IAM Executive Director/COO Chris Holland says “This should be a good opportunity for brand building, fan engagement, and the organization. Thank you, Michael Woodall, for your work to acquire and safeguard this great piece of drum corps history that also generates revenue to further the programs offered by Inspire.”

According to the seller Wayne Terminello “The Fleetwood Drum & Bugle Corps CD series has been digitally re-mastered from original recordings by Fleetwood from 1958-1975. The latest digital recording and mastering technology has been used to provide the best quality recordings possible. I could not be happier to do this deal and know that the Fleetwood collection will be in good hands with an organization that truly cares about the activity.”

“I can still remember my brother Rick playing me my first Fleetwood record when I was 8 and would have never imagined purchasing the company at that time. This critical part of Drum corps history will be preserved forever and also gives Inspire and the Boston Crusaders a significant amount of content to use to attract more fans and revenue!” said Woodall.

This deal continues on the recent expansion to Inspire’s programs, all of which focus on meeting the organization’s mission while bringing positive revenue streams to increase the financial health of Inspire. This deal will be coordinated and partnered with recent acquired assets including the Great East Music Festivals, the new Great East Music Store (GEMS), the partnership with Yamaha to utilize and sell equipment through GEMS, and the recently formed Inspire Investment Club. All of these initiatives share the same goal of positioning Inspire to provide leadership and life lessons through the arts for thousands of young adults in the New England area and across the country.

This is another exciting move for our organization!

This is really cool, and I plan on taking advantage of this, as I want to expand my collection of recordings.

One question though (because I honesty don't know the answer), how do you deal with the rights to music in recordings that old?

I wondered the same thing about the copyrights of the tens of thousands of music on these old recordings. Would they have to pay the publishing companies before they release these remastered albums? I'm just wondering if this is a head ache waiting to happen for the new owners. Time will tell.

If they ever need more recordings, I've got dozens of those Fleetwood albums sitting around in my basement, taking up space. LOL.

I think this is the answer...

Statute of limitations on copyright violations is between three and five years.

So the window for both civil and criminal suits of those unlicensed arrangements has expired.

Audio recordings are released under a statutaory (compulsory) mechanical license.

There is a standard fee per song and it is very affordable. You pay after the product is SOLD, not created.

And you just pay the Harry Fox company. So pretty easy to take care of.

IIRC there is also the headache of who owns the rights of the actual recording. In this case not a problem as Fleetwood recorded and owned the rights from the start.

Seriously doubt Fleetwood ever received permission from the publishing companies to record the music and sell those recordings. Like I said before, this could be a whole new can of worms here. I'm sure moving forward the new owners of Fleetwood will do what they have to do to gain permission to sell these recordings from here on out. I'm just wondering if publishers will go after some sort of settlements from years before of not having permission to record and profit from those recordings.

if you a sell newly pressed version of 1969 Cabs, (or anyone else)..................it is a copywrite violation without rights to arrange, perform, and mechanically produce,.............

The mechanical rights are the only ones really in play here. We're talking about an almost 50 yer old recording, and the laws regarding arranging and performance rights were much different, rarely enforced, and largely ignored. There may even be a statute of limitations in effect, or even copyright law amendments that affect arranging/performance rights. Either way, it's unlikely that any publisher would pursue action on those grounds.

But yes, the mechanical rights would still have to be secured (and may even be denied out of spite by some publishers).

It will be interesting to see how Inspire handles the Fleetwood library going forward...
