Well if the stadium owners knew well in advance there was a conflict why did they wait to tell the corps sponsors they couldn’t have the stadium?

Answer was Herco didn’t know until just a few months ahead of time. From what I read the reunion was a surprise to everyone and not something planned year ahead. Again this was after Destinys Child broke up and only reunited for special events

that concert, for equipment, gear, etc... was already through the production office a year out and a hold was placed on multiple dates.   you can believe what you want, but i'm telling you, as someone who lives in production, we have those things on the calendar well before anyone else does.  we have budgets and riders well ahead of whatever you read in the paper or online, because we have to have numbers for the producers and sponsors long before anything goes public.  we also operate under NDA's which means we can't tell you what is in the works, until the tickets go on sale.

So you know what went on with that particular tour for that particular year.....Shrug, don’t remember NDAs being discussed at the trial as a defense. But either way the NDA worked well as believe show sponsors had the corps lined up (so much for those contracts) and sent out flyers for tickets....

moral: if you’re local don’t do business with Herco....

Was there a signed contract with a corresponding deposit or a P.O.?

If you mean between Herco (stadium owner) and show sponsor, Herco does not do signed contracts be it Drum Corps show or Big33 football game.

If you plan an event without a contract can you really blame the stadium?

Here’s the problem:

1) stadium owner refuses to sign a contract

2) stadium owner has best stadium in the area by far

3) stadium owner knows #2

Harrisburg area may have state capital but every other stadium in a good 20 radius is either high school or minor league baseball. No college or municipal stadiums so only big time stadium is privately owned.

like I said before it’s a crap shoot and Herco has the lawyers to do it legally.... Shocker to me was hearing Big 33 couldn’t get a signed stadium contract. It’s a all star HS football game between PA and another states (usually OH) players. Player get together week or so before the game to learn plays and do lot of PR work for Big 33 (Ronald McDonald house and nearby hospital has children’s section). Lot of publicity generated but Herco could do what they want here also...

well... if people don't go, why hold a show?

if you fund it, the stadium will have it.

people went. 6-8000 people a year. however configure the stadium for a concert, you can get 30,000 in there. Plus Herco refused to work on ironclad contracts, with all kinds of vaguness and charges being added at the last minute. I attended the court hearing of the lawsuit  the show promoter brought against Herco. It was eye opening what Herco could get away with legally, with the judge themselves even stating certain aspects were shady at best.

notes are in the DCP archives

Maybe you should ask instead of assuming wrong...

Actually good attendance for a drum corps show. But when a rock concert seats people on the field along with the stands we’re talking about 25K warm bodies. And Beyoncé, Springsteen, Billy Joel, U2, etc pay a helluva lot more for stadium rental.

Big part of the problem is Herco refuses to sign contracts for stadium rental. Last Hershey corps show was scheduled but then Herco got a better deal with Destinys Child and killed the corps show. It went to court but since there wasn’t a signed contract Herco won the suit against them. So why try to hold a show and hold your breath that you will not lose the site? IMO this killed any chance for a future corps show than anything else. Weird thinking that the DCA Finals hosted at Hershey could have been killed if someone else came up with a better offer.

Hershey Stadium has hosted Big 33 high school football game for decades. Possibly biggest publicity of any event held there as between PA and another states best HS players. Few years back one of the Big 33 heads said they can’t get Herco to sign a contract either.

hershey was set to bid for 2006 when everything went to hell. They obviously withdrew. Dan Acheson even testified by phone he'd be very leery of anyone trying to run a DCI event in Hershey again given their practices.

Just saying that it's a known risk. Can't be upset when it happens and if there is no alternative in the area, then it's not s good area to hold the event.

I hear ya, Jim... Hershey is a different animal altogether. Don't know for sure, but perhaps one reason the fall band shows have been safe there is that there are no outdoor concerts then.  LOL.

To make a long story short... I remember in 2000,  one concern about DCI possibly running at Fedex Field in the DC suburbs was that the owner of the Redskins could pull the plug at any moment on a whim... even with a signed contract. Dude was/is a loose cannon, IMO.

So the show eventually ended up at College Park that year.

and later fall. One of the HS football tenants of Hershey Stadium wanted to run an early September show for TOB, and Herco told them they couldn't guarantee anything. Herco also lets the PIAA pay a lot of money to leave the stadium sit empty all day on some later fall Saturdays
