    Dear 2020 Blue Devil Members,

    We are writing to you to share important information in these unprecedented and difficult times. We know that your daily lives have been disrupted with changes in how you attend school or work, and interact with your family. We understand that with this disruption, it brings a great deal of uncertainty. We acknowledge that Drum Corps and its related activities are extremely important to you. We also understand that everyone was committed to an amazing 2020 summer and you have made considerable sacrifices to participate.

    Every decision we make, we consider you and all the individuals involved with our organization.

    We have been closely following and adhering to the guidance of the CDC and WHO, and we are committed to providing the safest possible environment, now and through these challenging times. Global health and economic conditions are currently affecting our ability to operate BDPA programs amidst these challenging circumstances.

    After much deliberation with the Drum Corps International Voting Membership, the decision has been made to cancel the 2020 DCI summer tour. We at BD Performing Arts agree and support this decision. As a result, we are cancelling the Blue Devils 2020 summer tour and suspending all in-person activities for the immediate future. This includes BD International. Diablo Wind Symphony students, please stay up to date on the DWS web page about end of season events and auditions. John Maltester will be in contact.

    We firmly believe that these conditions will not persist indefinitely. We will continue to work on all options available to us during this time. We intend to use the remainder of the 2020 calendar year to prepare for the future.

    Many of you that have participated with the Blue Devils know we have never given up in any situation, and we will not start now. Look back on your many years of involvement. We all will draw on that strength of determination and conviction. We won’t back down. Ever. We will rally around each other at this time like we have done in the past, and be there for each other now in these uncertain times. You and everyone involved in the Blue Devils have always risen to every challenge we have faced, and we are determined to collectively meet this one confidently and unafraid.

    DCI has passed a rule change for all members whose last year of eligibility was the 2020 season. These members will have their eligibility extended and will be able compete in the 2021 season. This measure will only apply to those participants “aging-out” in 2020 and shall not further extend to those scheduled to become ineligible in 2021 or beyond.

    We are aware that this information will create questions. We will have a Zoom meeting at 5:00pm PDT Thursday, March 26 with the Blue Devils A Corps; and Friday, March 27 at 5:00pm with the Blue Devils B Corps to personally meet with all of you and answer questions. Please see you email from us in your inbox with details.

    The Blue Devils have been defined by very specific philosophies. As we look forward, it is appropriate to look back on the words of our founder, Jerry Seawright, when he was moving us from a drum and bell corps to the current Blue Devils:

    We believe in supporting the health and well-being of all participants in BD Performing Arts programs, including our members, staff, volunteers, and families.

    We have been closely following and adhering to the guidance of the CDC and WHO, and we are committed to providing the safest possible environment, now and through these challenging times. We intend to use the remainder of the 2020 calendar year to prepare for the future. Our hearts go out to the thousands of performers in the pageantry activity that have been affected by the coronavirus crisis.

    To be able to resume our programs at the appropriate time, we must maintain a minimum level of funding. At this time, we ask for your help to keep BDPA in operation.

    More than ever, We Need You! As you know, BDPA is a nonprofit organization. As such, the ability to execute our mission successfully requires ongoing philanthropic support from individuals like you along with funding from our BD Bingo program, which is currently closed due to the coronavirus. To ensure that we can resume our programs at the appropriate time, we ask you to consider making an investment in BDPA while we face this rapidly changing public health crisis.     Kinda sorta Rich lol. It is, in fact, for wood and more specifically for pool cues. But with the right router (this one's a kress 1050) it will cut steel or aluminum at slow speeds. It's basically a souped up 6ft x 4ft 4 axis cnc mill. I've added a vacuum table and a rotary axis on a separate bed. 

    I didn't design it at all. Xymox really did the frame for this years ago and I just added stuff to it to make it more specific to cues. It's taken this long to get it set up. I did all my inlay by hand for years, then went to a big pantograph mill and now finally to cnc. Fun stuff. 

    That's super. I was interested in woodworking for a while. I built all of my own furniture before going to school and going into HVAC as a A/C technician.

    Decided to check out the Drum Corps Reddit posts to see what was happening there and found out the following info regarding the Tresona topic which provides some added info regarding the topic..

    Facts:

    Large national choir mish-mashed over 100 songs into their performance. They purchased a custom arrangement, but didn't seek licensing for the individual original songs.

    Since they are a super popular choir, Tresona found out, and sued the director, boosters, and several individual parents claiming Tresona was the sole copyright holder of of the written music rights in the US and Canada (they claimed they controlled 70 of the songs, but only sued over 4)

    Tresona buys these music rights from big companies like PEN and BMI, giving them the ability of assignment (the ability for Tresona to give licenses)

    Turns out PEN/BMI never had the authority to grant the assignment to Tresona, because PEN/BMI never completely owned those songs. Songs are often written by multiple people, and PEN/BMI was not representing all of the people involved, in one case they were trying to grant assignment to Tresona for a song they only controlled 25% of.

    So in 3 of the 4 songs Tresona was suing for, the court ruled they did not have standing to sue, because PEN/BMI never had the authority to grant Tresona assignment of those rights in the first place.

    The panel stated that it was especially swayed by the limited and transformative nature of the use and the work’s nonprofit educational purposes in enhancing the educational experience of high school students. The panel concluded that the music director’s use of a small portion of the song, along with portions of other songs, to create sheet music for a new and different high school choir showpiece performance was a fair use.

    My opinion: So in one case, they did conclude that fair use was correct. In the other three cases, they simply ruled Tresona doesn't have the ability to sue. There is no word on if the other 3 were considered fair use, because they ruled Tresona didn't have the right to sue, and stopped there. I would still consider this a gray area as to whether any arrangement for a choir could be considered fair use. The work must hold to some really strict guidelines of fair use legally, and if you're popular enough for Tresona to notice you, you would probably need to be prepared for a lawsuit to defend yourself.

    Tresona only sued over 4 of their claimed 70 songs that were infringed, meaning they thought they had the best case on those 4 songs, and they still lost. This doesn't bode well for them, however it also creates headaches for groups like DCI. If Tresona is no longer valid, each group will need to somehow verify copyright status for every song they decide to perform. This can get really tricky, as we've seen from this lawsuit (if 4 people/companies own 25% rights of a song you need permission from all of them), and could further restrict musical selections that might take too much time and effort to get the rights to. Tresona is not well-liked, but it was supposed to be a simple way to know your large scale performance was licensed properly.

    The BDPA SCHOLARSHIP FUND
    The BDPA Scholarship Fund is to promote innovative excellence in a young person's life. It is awarded to help fund a member's education for their future career
    pursuits so to enhance their BDPA performance experience.

    A maximum of three $500 scholarships are awarded each year at Family Day.  Awards are selected by the BDPA Scholarship Committee which is directed by the BDPA Board of
    Directors.

    ENDOWMENT
    For years, BDPA has relied on few sources of revenue to fund program expenses. Realizing that even a small shift in the local economy and continued pressures on our
    fundraising activities could have devastating effects, the Board of Directors has moved to secure a stable foundation for our organization. In order to assure that

  7. NY to start experimental treatments for COVID-19

    Some experts say the side effects are risky, but Chloroquine has been used to treat malaria and was approved to treat malaria by the FDA in 1949. Adhering to strict dosage amounts, it is currently being tested in NY.

    On Monday, Gov. Andrew Cuomo announced that New York’s Department of Health would begin testing an experimental drug therapy and plasma treatment as possible treatments for COVID-19.

    Cuomo said that the Federal Food and Drug Administration gave the department approval to move forward with a combination drug therapy of hydroxychloroquine and zithromax to treat extremely ill COVID-19 patients. On Sunday, the governor said that the state has purchased “70,000 doses of Hydroxychloroquine, 10,000 doses of Zithromax and 750,000 doses of Chloroquine,” in anticipation of drug trials that will begin on Tuesday. 

    Chloroquine, a treatment for malaria, made it into the news last week, after President Donald Trump listed the drug as a possible treatment for COVID-19. However, there is only “anecdotal evidence” that chloroquine could be a viable treatment for the virus, according to director of the National Institute of Allergy and Infectious Diseases Dr. Anthony Fauci. And only drug trials will be able to prove the effectiveness of the malaria treatment on COVID-19 patients.

    The FDA has also given the state permission to begin testing a serum derived from patients that have recovered from the virus, to help sick patients build up their immunity to it. The state will begin asking recovered COVID-19 patients to donate their plasma, used to make the serum, within the next few days. Injecting plasma from recovered patients into sick patients is a technique that has been used to fight off disease since the 1890s and has helped curb numerous outbreaks of the measles, mumps and influenza. Most recently the technique was used to suppress the H1N influenza outbreak in 2013.

    In law, standing or locus standi is the term for the ability of a party to demonstrate to the court sufficient connection to and harm from the law or action challenged to support that party's participation in the case. Standing exists from one of three causes:

    1. The party is directly subject to an adverse effect by the statute or action in question, and the harm suffered will continue unless the court grants relief in the form of damages or a finding that the law either does not apply to the party or that the law is void or can be nullified. This is called the "something to lose" doctrine, in which the party has standing because they will be directly harmed by the conditions for which they are asking the court for relief.
    2. The party is not directly harmed by the conditions by which they are petitioning the court for relief but asks for it because the harm involved has some reasonable relation to their situation, and the continued existence of the harm may affect others who might not be able to ask a court for relief. In the United States, this is the grounds for asking for a law to be struck down as violating the First Amendment to the Constitution of the United States, because while the plaintiff might not be directly affected, the law might so adversely affect others that one might never know what was not done or created by those who fear they would become subject to the law – the so-called "chilling effects" doctrine.

    In other words, in this case Tresona was not harmed and therefore lacked standing.

    judgment in favor of the vocal music director at Burbank
    High School and other defendants in a copyright suit and
    reversed the district court’s denial of attorneys’ fees to
    defendants.

    Tresóna Multimedia, LLC, a licensing company,
    claimed that the Burbank High School student show choirs
    failed to obtain licenses for their use of copyrighted sheet
    music in arranging a show choir performance. The panel

    individual co-owners of copyright, without the consent of

While I understand there are many variables that play into a units performance on any given nigh, since I have nothing to do for two weeks, I figured I might as well try something!     The Star of Indiana Drum and Bugle Corps (also known simply as, "Star") is a defunct competitive junior drum and bugle corps. Based in Bloomington, Indiana, the corps was the 1991 Drum Corps International (DCI) Open Class (now World Class) World Champion. 

    The DCI Years

    The Star of Indiana Drum and Bugle Corps was founded in 1984 in Bloomington, Indiana. Its startup was funded with a grant of $1,000,000 from Bill Cook and his medical device manufacturing company, the Cook Group. Marching a then-maximum one hundred twenty-eight members under the directorship of Jim Mason, at the 1985 DCI World Championships in Madison, Wisconsin, Star of Indiana became only the second corps to earn a spot among DCI's Top Twelve Finalists in its first season of competition; the first corps to do so was the 1972 Bleu Raeders. Star of Indiana marched in DCI competition for only nine seasons, but finished in DCI Finals every year, twice finishing third, second once, and winning the 1991 DCI Open Class World Championship. In addition to its DCI title, Star also won the Drum Corps Midwest Division I Championship, 1991–93; the U.S.Open in 1988 & '89; the DCI Preview of Champions title, 1991–93; and ten DCI Regional Championships, 1988-93. 


    Brass Theater

    As early as 1992, Star's staff knew that they wanted the corps to do more than perform a ten-minute drum corps competition program. After the 1993 season, Star of Indiana departed the competition field and developed a new way of presenting drum corps. "Brass Theater" was designed to apply the powerful brass and percussion and the exacting choreography of drum corps to pop, Broadway, movie, and classical music to create an all new type of stage entertainment. Touring with the Canadian Brass, the world's most popular brass quintet, "Brass Theater" was a hit with fans and critics alike on a ten city tour in 1994. Star and the Canadian Brass toured again in 1995 and '96 as "Brass Theater II" and "... III" to even greater acclaim. The two groups also recorded three CD's of the "Brass Theater" programs. Then, in 1997 and '98, Star settled down to perform "Brass Theater" in a theater in Branson, Missouri. 


    Blast!

    In 1999, Star premiered the stage show, Blast! at the Hammersmith Theatre in London, England. After an unimpressive start, its audience steadily grew, until it became a top ten hit on the London stage. After a year in London, "Blast! returned to the U.S. in 2000, debuting on the Broadway stage to rave reviews. The show won the 2001 Tony Award for Best Special Theatrical Event, and, when it was videotaped for PBS, it won the 2001 Emmy Award for Best Choreography. After its Broadway run, Star took Blast! on the road, with companies touring the country each year to large and enthusiastic audiences. Casts were also developed to perform long-term engagements at Disneyland in Anaheim, California and at Disney World in Orlando, Florida. Blast! continued to tour through 2012.


    Alumni Corps

    In August 2010, Star of Indiana returned to the DCI World Championships. The alumni had previously gathered to perform, but on August 11, the Star of Indiana Alumni Corps performed after the last competing corps in DCI's semifinals at Lucas Oil Stadium in Indianapolis.[4] 

    One group of Star of Indiana alumni formed Star United, a mini-corps that competes at the Drum Corps Associates (DCA) senior drum and bugle corps championships. Star United won the DCA mini-corps championship 2006-2012 and 2014–18,[5] and scored a perfect 100.00 in the 2011 Finals. Star United also performed as a SoundSport team at the 2014 & 2017 DCI World Championships in Indianapolis. 

    After the 2010 alumni corps experience another group of Star alumni, consisting of past members of the Star of Indiana drumlines, decided to compete in the Drum Corps Associates ensemble competition by entering a 12 man drumline in 2011. They finished first place in their initial year. They continued to compete in the ensemble competition, fielding a 9 man drumline in 2012.[6]
