OK.

Phantom Regiment failed to choose music that DCI (an organization that Phantom Regiment is a member of) failed to secure rights. It's really splitting hairs, IMO, to argue blame, or who is technically responsible for securing copyright clearance (long story short: corps directors work in conjunction with DCI, and again Phantom is a member corps and DCI is run by the member corps directors).

This has been a subject in another post, but is also relevant here:

a) To secure *all* copyright permissions (arranging, performing, recording, syncing, etc) can take as long as a year and a half; which means corps would have to begin planning for, and requesting rights to, various shows at least two years in advance to make sure all permissions are secured. Due to the common nature of turn-over in corps design staff each year, as well as many other factors, it is therefore downright almost impossible for corps to implement those requests that far ahead. But, more importantly to the 08 situation ....

b) Even if permission is granted, if the Copyright Holder deems the arrangement, or the visual adaptation of the music, as (inappropriate) the holder can legally negate the permission after the fact. Apparently that is what happened in 08. So, in that situation neither Regiment nor DCI failed at anything.

We're really talking semantics. Again, I'm by no means laying blame on Phantom Regiment or DCI (though, it should be pointed out that in 2008 Phantom Regiment was the only DCI corps to not get all necessary copy right permission: i.e. every other DCI corps as granted all the necessary permissions, so it's not impossible for corps to get the necessary permission within the time frame of the season), even though it possibly reads that I am. Phantom Regiment, DCI, whomever failed to get all of the rights needed to put Phantom Regiment's entire, unedited 2008 production in the DVD's and Blu-rays: regardless of where the hang-up occurred, the appropriate permission was not granted to Phantom Regiment/DCI.

No, we are not just talking semantics:

a) You still seem bent on dogging on either Regiment or DCI because you reiterated it was the *only* glitch in 08; and that dogging on your part is just plain outright wrong because both Regiment and DCI did exactly what they were supposed to do; period. The sync permission *was* granted to DCI in 08 for the Regiment show; but for some reason it was revoked by the copyright holder after the fact. That is not semantics but a reality.

b) As for the extended time it takes to secure permissions, you must not be aware that DCI has to roll the dice every year because many of the corps are well into their tour before a yes/no answer is given to DCI on recording and sync rights. Why? Because the *Required* order of securing permissions are: Corps seek Arranging (which takes months), then after that permission is given to the Corps, DCI, not the Corps, but DCI seeks Performing, DCI seeks Recording, and DCI seeks Sync (notice sync is last on the list). Different entities normally own the rights to those various items which is why by the time a yes/no response for *Sync* is received it is well into summer tour. Most copyright holders do give DCI a Yes to sync permissions; but this typical time lag on receiving a response is, for example, what DCI (not the Scouts) ran into in 2011 on the No to sync the ESOM chart; and that was still *not* the fault of DCI or the Scouts because they did what they were supposed to do; period.
