Not a lawyer, but I imagine the DOJ distinguishes soliciting from operating for a reason. In delinquency, the law reads that neither are allowed. Without insider info, what are we supposed to think of an org who admits to financial challenges already? Agreed with other comments here that they've likely been advised not to say anything.
