  3. Well, yeah. HBO and company operate on a different model. They don't care about ratings or ads -- they only care about number of paying subscribers. As far as HBO is concerned, the more people that are watching, the better, regardless of how they are watching. Game of Thrones is the world's most illegally-shared television show, and HBO puts up a cursory (at best) effort to dissuade people from downloading it. You get hooked on HBO and then you either subscribe or buy Blu-Rays and they are happy campers.
  4. Fair use is very interesting. You have to remember though that we here aren't dealing with fair use of music, we are dealing with off-license use of sync'd and arranged music. It's a bit of a different breed. :)

  6. There's no such thing as "expressly legal under fair use." The Betamax case is the law of the land, and the court certainly held that recording television programs for later personal viewing is legal, but fair use remains one of the least defined concepts in IP law. And yes, a contract absolutely CAN restrict a person from doing something totally legal. I think you may be conflating "violation of law" with "contract rights." Example: It is 100% legal for me to walk down the street outside my house. I sign an agreement with you, whereby you will give me $5 if I don't walk down the street outside my house for 24 hours. This is an enforceable contract, and if I breach by walking down the street, I don't get the $5 at issue. Well, there's a bit of a distinction in that TV providers aren't operating expressly under the same parameters that DCI is. Namely, TV providers in most cases don't need to secure sync rights for music they use in their programs. Also, TV providers are now ALL TOO HAPPY for you to record their commercials, even if you don't watch them. The issue as I see it is not that the individual user is illegally downloading, so much as DCI is arguably violating its licenses by allowing such downloads to occur without disclaiming its liability. DCI doesn't have the rights to distribute recorded videos of corps' performances. If I were DCI's lawyer, I would advise them to tread lightly and amend the TOS to disallow stream grabbing. I don't think it will stop people from downloading, but it would certainly help DCI avoid some potential liability.
  7. I disagree that the TOS can't restrict such use. Making a contract not to do something that is otherwise legal is enforceable, so long as there is an exchange of consideration. (In this case, money in exchange for access to video streams.) If DCI got its act together (LOL) and updated its terms of service, it would certainly be in its best interest to prohibit grabbing the streams, simply because DCI clearly doesn't hold the copyright licenses required to distribute archived performances of performances. I can certainly see some lawyer for a publisher taking DCI to the cleaners because they didn't cover their ###. (Not to say that amending the TOS would actually make people stop -- it just wouldn't be DCI's problem anymore.)

  12. I think costuming and body movement are fads. This year's show makes me happy because it's what the Cadets do best -- playing and marching and doing crazy stuff that is cool.
  13. I know it's only been two weeks, but I can't imagine this show ever entering the "rarified air" of shows like Cadets 83, Star 93, BD 94, etc. More than anything, I think it was probably the finest example of a program matching the sheets in DCI history, combined with a great performance.

  17. Yes. It's been over three months since I saw it, and I'm still not sure whether I liked it or not, or whether it was good or not, but I'm definitely still thinking about it. It would take a very mature corps.
  18. I think you're probably right. It's very quiet, but incredibly atmospheric and there are some parts -- "Creation" -- that could probably hold their own. This might be something for someone like PR to explore. Or Vanguard.
  19. Cadets should do a Sigur Ros show about the seasons. I'm being completely serious. Also, I'd love to see anyone tackle the music from the recent film, "Under the Skin". It's the creepiest, but coolest pieces of film music I can remember, especially "Love". http://www.youtube.com/watch?v=hCGGmKTE2n8 Actually, all of the collateral/branding/design language from the marketing of that music could inspire something really cool.
  20. I can't believe (actually, given that this is DCP, I CAN believe) that this is a topic. I personally was the person in charge of getting the Cadets off the field after Finals retreat in two different seasons. Here is the truth: The Cadets have left the field immediately after scores were announced at every show, in every non-winning season since 1998, which is the last season that corps played themselves off. It goes like this: Final score announced DM returns to block "Listen up, Cadets: CORPS TEN HUT!" Corps comes to attention "Listen up, Cadets: Turning to your right in four. One two ready move." Corps turns 180 degrees to its right DM walks to the back of the block and leads the corps off the back of the field, walking out of time. This takes ~3 minutes. It has literally NOTHING to do with any other corps. It's the Cadets being the Cadets. It's just like when corps used to leave things on the field after retreat -- notes, shoes, etc. The Cadets left nothing. It's just like when corps wear medals from other seasons on retreat. The Cadets don't. It's just like when corps wear championship rings over their gloves. The Cadets don't. It isn't about George. It isn't good. It isn't bad. It's just the Cadets being the Cadets.
  21. OP, I'm not going to boo or anything like that. I love the Cadets. I'm the honkiest honk that ever honked. I want the Cadets' show to be my favorite show every year. It is not my favorite show this year. In fact, it seems rather like a misfire. Therefore, I am a bit frustrated, but look... I strapped into that uniform ~200 times. I know what it is like to work under that system. Everyone who does it deserves respect and admiration. Anyone who would outwardly boo a kids' marching band performance or be somehow offended by it needs to have their head checked, anyway!
  22. I'm in the airport waiting for my flight to Indianapolis, and I don't think I'm even interested in seeing this anymore. It borders on cringeworthy for me.
  23. Peter Luger has pretense? St Elmo probably is a better value... that's for sure. And I think they take credit cards.
