(interesting how you seem to miss all the other points in my replies) In any case please supply us with just one alternate piece that is: - a modern pop tune - about NYC - with an uplifting feel - arranges well for brass - is not encumbered with rights issues - works as well with the show design as ESOM I'm sure there must be many such tunes in your wide universe of musical knowledge. Look a little closer in that Google/Wikipedia generated list and you'll find all of your criteria met many, many times. And in any case (as NE Brigand pointed out) Madison had absolutely no reason to believe there was a need for a replacement. They clearly believed that the sync rights would easily be settled before it came time to start burning DVDs. It was just a case of sh## happens and so it did. There's no crisis.
