Blue Devils and Channel One Suite

Would it not be listed in the program as part of their program? I would think that if DCI is producing DVD's and listing the show's with musical selections ... it would have to include ALL musical selections being used in whole or in part. Would they not? Otherwise, not only would BD have to have the rights, they would also have had to send out a synchronization application with DCI and the copyright holder for Channel One Suite.

If they did not, and it is later challenged by the copyright holder ........... a few things could/should happen.

1. BD would have to negotiate the rights and get the synchronization rights handled prior to release of the DVD's and CD's.

2. DCI would have to list Channel One Suite on all of their audio visual merchandise for BD and pay the rate per sold as agreed to by the copyright holder.

3. If no agreement is made ... The whole mid section of BD's show would have to be omitted on the DVD and CD's ... including every post on Fan Network.... and a potential lawsuit from the copyright holder could ensue.

4. If an agreement is made, DCI would have to pay retroactive on all APD and VOD sales of BD performances, which could be a reallllly big hassle in calculating.

End result, big chunk of show not on DVD or CD's.

I ...HOPE .. they covered all their bases and got rights. I'm just saying, if a few people are picking up on it, all it takes is the wrong person to make a phonecall and ............. well you get the picture.

If you really think BD doesn't have these bases covered....I would think EVERYone would've learned from 08 Regiment (even though that wasn't really their fault).

I don't think whoever holds the copyright to CoS is gonna care about a program listing for snippets of the work....they want the permission sought and any fees paid.

Not that they don't have their bases covered, but can't you use a snippet for free? I thought the limit was 20 seconds. That is how all of the tv and radio shows get away with "bumper" music. BTW I may be totally wrong so correct instead of flaming me if I am.

If you really think BD doesn't have these bases covered....I would think EVERYone would've learned from 08 Regiment (even though that wasn't really their fault).

Part of the show was removed from later editions of the DVD (thankfully, I have my preorder version that has the complete show) since Loris Tjeknavorian didn't like what Regiment did with Dance of Ecstasy from “Danses Fantastiques”, and revoked usage rights.

Not a real fan of the guy after he did that.

I thought we were supposed to return the original DVD for the modified one. I know they had to do it, but I wonder how many they really expected to return them and how many actually did.

No, you cannot use a snippet for free. Whether you use one measure or forty measures, if it's recognizable, it requires permission.

Radio and television broadcasters pay for what they use.
